Stephen Phillip Maslan, Kansas City, MO; Case Number D–37697
Violation: In another jurisdiction, Mr. Maslan failed to practice engineering in an ethical, professional, careful and diligent manner, which when measured by generally accepted engineering standards and/or procedures endangered the public health, safety, and welfare. Mr. Maslan failed to properly and promptly notify the Board he had been disciplined thirteen times by other jurisdictions’ regulatory agencies. Because Mr. Maslan no longer desired to practice engineering in Texas and to resolve this pending disciplinary case, he signed a Voluntary Surrender Affidavit of his license which resulted in the revocation of his license.
Act/Rule Violated: 22 TAC §137.5(c) and in accordance with 22 TAC §137.65(b), if Respondent's conduct had occurred in Texas, his actions would have violated 22 TAC §§ 137.33(e), (f), and (n), 137.55(a) and (b), 137.57(a)(3), and 137.63(b)(1), (b)(4), and (b)(6).
Resolution: Revocation.
Gary W. Jaster, P.E. (Inactive), Austin, TX; Case Number D–37034
Violation: Mr. Jaster neglected to directly supervise the engineering work performed, which contained substantial deficiencies, thus endangering the public health, safety and welfare. Mr. Jaster offered and practiced engineering while his professional engineer license was expired.
Act/Rule Violated: Tex. Occ. Code §§ 1001.004(c)(2)(A)–(c)(2)(C) and 1001.301(a) and (b)(2) and 22 TAC §§ 137.7(a), 137.33(b), 137.55(a) and (b), 137.57(b)(3), and 137.63(a) and (b)(6).
Resolution: Permanent Inactive Status and Administrative Penalty of $12,677.00.
Douglas Kent Miller, P.E. #78419, Houston, TX; Case Numbers D–35068 & D–36628
Violation: Mr. Miller neglected to practice engineering in an honest, ethical, careful, and diligent manner by issuing a misleading engineering certificate. Mr. Miller failed to properly label engineering documents as preliminary. Mr. Miller failed to promptly respond to the Board's request for information.
Act/Rule Violated: 22 TAC §§ 137.33(e), 137.57(b)(1)–(3), and 137.63(a) and (b)(6).
Resolution: Four Year Probated Suspension contingent on remittance of an Administrative Penalty of $9,500.00 and successful completion of Texas Tech University Engineering Ethics Intermediate Course.
Thomas W. Keiss, Fort Worth, TX; Case Number B–37520
Violation: Mr. Keiss offered and practiced engineering with a revoked license and falsely signed and sealed engineering documents indicating a professional engineer performed or directly supervised the work.
Act/Rule Violated: Tex. Occ. Code §§ 1001.004(c)(2)(A) and 1001.301(a) and (d)–(e) and 22 TAC §137.37(b).
Resolution: Cease & Desist Order, Restitution of $360.00 and Administrative Penalty of $8,154.00.
Miguel Castillo, Garland, TX; Case Number B–37584
Violation: Mr. Castillo offered and practiced engineering without being licensed by the Board and falsely signed and sealed engineering documents indicating a professional engineer performed or directly supervised the work.
Act/Rule Violated: Tex. Occ. Code §§ 1001.004(c)(2)(A) and 1001.301(a) and 22 TAC §137.37(b).
Resolution: Cease & Desist Order and Administrative Penalty of $6,000.00.
William “Billy” James Wilson, Plano, TX; Case Number B–37429
Violation: Mr. Wilson offered and practiced engineering without being licensed by the Board and unlawfully represented to the public he was a professional engineer. Mr. Wilson’s business entity offered and provided engineering services without being registered with the Board.
Act/Rule Violated: Tex. Occ. Code §§ 1001.004(c)(2)(A)–(C), 1001.301(a), (b)(2), and (c), 1001.405(b)(1)–(2) and (e) and 22 TAC §§ 137.77(a) and (d).
Resolution: Cease & Desist Order and Administrative Penalty of $3,000.00.
Richard E. Weathers, P.E. #57468, Waco, TX; Case Number D–37421
Violation: Mr. Weathers failed to practice engineering in a careful and diligent manner by issuing a misleading engineering report.
Act/Rule Violated: 22 TAC §§ 137.57(a)(3), 137.63(a), and 137.65(b)(5) and (b)(6).
Resolution: One Year Probated Suspension contingent on remittance of an Administrative Penalty of $1,592.00.
William “Bill” Wesley Ruth, San Antonio, TX; Case Number B–37318
Violation: Mr. Ruth unlawfully practiced engineering jeopardizing the health, safety, and welfare of the public.
Act/Rule Violated: Tex. Occ. Code §§ 1001.004(c)(2)(A) and 1001.301(a).
Resolution: Cease & Desist Order and After-the-Fact Engineering Inspection Report.
Blackaller Engineering, Inc. (F–4601), Longview, TX; Case Number B– 37821
Violation: Blackaller Engineering, Inc., offered to provide consulting engineering services while Respondent's registration was expired.
Act/Rule Violated: Tex. Occ. Code §§ 1001.405(b)(1) and (e)(1) and 22 TAC §§ 137.77(d)–(e).
Resolution: Cease & Desist Order and Administrative Penalty of $250.00.
