August 26, 2010, Board Meeting Disciplinary Actions

Case Number:  D-31995: Iden Iram Trevino, P.E.; Weslaco, Texas.
Violation:  It was alleged that Mr. Trevino signed and affixed his Texas engineer seal to several WPI-2 Forms that were submitted to the Texas Department of Insurance (TDI) for windstorm inspections of several residential structures certifying that the projects met windstorm codes.  It was also alleged that TDI requested additional information/documentation from Mr. Trevino to substantiate his certifications for these structures; however, Mr. Trevino failed to provide TDI with the requested information.  Therefore, it appeared that the WPI-2 forms were misleading regarding the structures’ compliance with the cited code, that Mr. Trevino had not acted in a careful and diligent manner and that his actions indicated he was not acting as a faithful agent to this clients.
Resolution:  Two year probated suspension, the assessment of a $2,160.00 administrative penalty and completion of an engineering ethics course.

Case Number:  B-32023: Lynn Kramer; Steamboat Springs, Colorado.
Violation:  It was alleged that Mr. Kramer prepared engineering design plans and performed engineering calculations for the construction of a pedestrian bridge project in Texas which were issued by his firm, Lykken and Kramer Consulting Structural Engineers.  Board records show that Mr. Kramer was not licensed in Texas as a professional engineer nor was his firm registered with the Board.  Therefore, it appeared that Mr. Kramer’s practice of engineering was unlawful and his firm unlawfully provided consulting engineering services for this Texas project.
Resolution:  Cease and desist from the practice engineering for Texas projects and from the representation that he or his firm can offer/provide engineering services to the public of Texas until such time as he becomes licensed in Texas as a professional engineer and his firm becomes registered with the Board; and a $1,720.00 administrative penalty.

Case Number:  B-32194; Keith Redmon; Richardson, Texas.
Violation:  It was alleged that Mr. Redmon identified himself as a Texas licensed professional engineer by using the designation “P.E.” and the Texas license number “50315” after his name in email correspondence which also included electrical engineering designs offering to provide engineering design services for a Texas project by his firm, Consultant and Construction Management.  Board records show that Mr. Redmon was not licensed in Texas as a professional engineer nor was his firm registered with the Board.  Therefore, it appeared that Mr. Redmon unlawfully represented himself to be a Texas licensed professional engineer by using the “P.E.” designation and the Texas engineer license number after his name, and he unlawfully offered to  practice and to provide engineering services for the public of Texas.
Resolution:  Cease and desist from any and all representations that he or his firm can offer/provide engineering services and from the actual of practice of engineering to the public of Texas and from the use of the designation “P.E.” and any Texas engineer license number after his name or any other representations that he is licensed in Texas as a professional engineer until such time as he becomes licensed in Texas as a professional engineer and his firm becomes registered with the Board; and a $3,290.00 administrative penalty.

Case Number:  E-32031; J. Edward Vasquez; Midland, Texas.
Violation:  It was alleged that Mr. Vasquez identified himself as a Texas licensed professional engineer by using the designation “P.E.” after his name on a business card and on an American Society of Civil Engineers election ballot dated January 8, 2009.  Board records show that Mr. Vasquez’s Texas engineer license expired on June 30, 2006, and became non-renewable on June 30, 2008.  It was further alleged that Mr. Vasquez also signed and sealed engineering documents for Texas projects after his Texas engineer license expired.  Therefore, it appeared that Mr. Vasquez unlawfully represented himself to be a Texas licensed professional engineer by using the designation after his name and that his practice of engineering for the projects which he prepared, signed and sealed engineering documents was unlawful.
Resolution:  Cease and desist from any and all representations that he can offer/provide engineering services and from the actual of practice of engineering to the public of Texas and from the use of the designation “P.E.” after his name or any other representations that he is licensed in Texas as a professional engineer until such time as he becomes licensed in Texas as a professional engineer; and a $2,500.00 administrative penalty.
